    1.0 OPENING MATTERS

    2.0 PUBLIC COMMENTS
    At this time, the public is permitted to address the City Council/Redevelopment Agency on non-agendized items.  COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES.  In accordance with State Law, however, no action or discussion may take place on any item not appearing on the posted agenda.  The City Council/Redevelopment Agency may respond to statements made or questions asked or may request Staff to report back at a future meeting on the matter.  Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Council/Redevelopment Agency agenda.  The exceptions under which the City Council/Redevelopment Agency MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code §54954.2(b)(1)(2)(3).

    3.0      CONSENT CALENDAR
    Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council/Redevelopment Agency with one single action.  Members of the audience, Staff or the City Council/Redevelopment Agency who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor/Chair to remove the item.  Members of the public should submit any Speaker Cards to the City Clerk in advance of the Consent Calendar being considered by the City Council/Redevelopment Agency.

    3.2       Waive the Second Reading and Adopt an Ordinance to Amend
                Chapter 10 of Title 2 of the Oakley Municipal Code, Dealing with
                Holidays (Bill Galstan, Special Counsel)

    3.3      Waive the Second Reading and Adopt an Ordinance Adding Chapter
                31 of Title 4 of the Oakley Municipal Code dealing with Water
                Efficient Landscape Requirements (Joshua McMurray, Senior
                Planner)

    3.4      Adopt a Resolution Approving an Agreement with Odyssey
               Landscape Company, Inc. for the Construction of
               CIP No. 119 (Cypress Road Landscaping) (Jason Vogan,
               City Engineer)

    3.5      Accept City Investment Report for the Quarter Ended December 31,
               2009 (Paul Abelson, Finance Director)

    3.6      Adopt a Resolution Authorizing the City Manager to Execute an
              Agreement with Kleinfelder West, Inc. related to Pavement
              Assessment & Remediation Recommendations Related to
              Sierra-Crete Sub-Base RFP (Jason Vogan, City Engineer)

    3.7      Adopt a Resolution Approving a Second Amendment to 
               Subdivision Improvement Agreement with Forecast Land
               Investment, LLC for Subdivision 8736 (Pheasant Meadows) and
               Authorizing the City Manager to Execute the Amendment
              (Jason Vogan, City Engineer)

    3.8      Adopt a Resolution Accepting 2008-09 CIP Project No. 85 (O’Hara and
               Neroly Median Improvements) as Constructed by Bay Cities Paving
               and Grading Inc., as Complete and Directing the City Clerk to File a
               Notice of Completion with the County Clerk (Jason Vogan, City
               Engineer)

    3.9      Adopt a Resolution Approving an Agreement with Francisco &
               Associates, Inc. for Assessment District Engineering and Authorizing
               the City Manager to Enter into the Agreement; AND Adopt a
               Resolution Appointing Francisco & Associates, Inc. as the Engineer of
               Work for the City of Oakley Street Lighting and Landscape
               Assessment District No. 1 for Fiscal Year 2010/2011 (Jason Vogan,
               City Engineer)

    3.10 Adopt a Resolution Accepting CIP Project No. 106  (Laurel Extension Landscaping) as Constructed by Green Valley Group, dba Green Valley Landscaping, as Complete and Directing the City Clerk to File a Notice of Completion with the County Clerk (Jason Vogan, City Engineer)

    3.11   Adopt a Resolution Accepting 2008-09 CIP Project No. 14 (Citywide
               Pavement Management - Neroly Road) as Constructed by Teichert
               Construction as Complete and Directing the City Clerk to File a Notice 
               of Completion with the County Clerk (Jason Vogan, City Engineer)

    Redevelopment Agency

    3.12   Accept Redevelopment Agency Investment Report for the Quarter
              Ended December 31, 2009 (Paul Abelson, Finance Director)

    3.13   Adopt a Resolution Approving Lease Agreement with Bill Lancaster
              of Bill’s Auto & Truck Repair for Agency Property Located at 3960 &
              3962 Main Street, Oakley (Bryan Montgomery, Executive Director) 


    4.0     PUBLIC HEARINGS

             Ordinance No. 20-06 and Determination of Whether to Earmark
             Potential Reinstated Amount to Charitable Organizations (William
             Galstan, Special Counsel)

    • Adopt the resolution reaffirming the approved and legislatively-enacted salary increase OR
    • Direct staff to prepare a resolution tying all or a portion of the reaffirmed salary to charitable contributions
